CONSIDERATION FOR SPOUSEL MAINTENCE (F.K.A. ALIMONY):

The information contained below is based upon our interpretation of the statutes, our experience in family law and what we think most judges will order with this experience in mind.

The statutory basis is set out in the Arizona Revised Statues §25-319 which requires the court to consider some important items. The most significant of which, is whether the person seeking this award can be financially self-sufficient without it. Questionably, can the person seeking the award live on their own with or without some help from another (likely an ex-spouse)? This would also include considering whether the person that would pay, could also provide for them self while paying something for the other person. If so, there is a likelihood that an award would be given in an amount and a length of time that the judicial officer orders.
